§201. Short Title.


This Chapter may be cited as the Alcohol Restriction Act of 1994. [P.L. 1994-107, §1.]


§202. Restrictions.


(1) No person under the age of 21 years shall purchase, consume, drink, or possess alcoholic beverages or other intoxicating liquors, or shall enter or remain in or be allowed to enter or remain in any bar in the Republic.


(2) No bar in the Republic shall remain open later than 12 am on weekdays and 2 am on weekends. [P.L. 1994-107, §2.]


§203. Penalty.


(1) Any person who purchases, consumes, drinks or possesses alcoholic beverages or other intoxicating liquors, or enters or remains in any bar in the Republic in contravention of the provisions of Section 202 of this Chapter shall be guilty of an offense and shall upon conviction be liable to a fine not exceeding four hundred dollars ($400) or to a term of imprisonment for a period not exceeding six (6) months, or both.


(2) Any bar or package store that sells alcoholic beverages or other intoxicating liquors to any person under the age of 21 years, arid any bar that allows any person under the age of 21 years to enter or remain on or in its premises; and any bar that remains open later than the times set forth in Section 202(2) above, shall be guilty of an offense, and shall:


(a) upon first conviction, be liable to a fine not exceeding $500, or to closure for a period not exceeding 2 days, or both: and


(b) upon second conviction, be liable to a fine not exceeding $1000, or to closure for a period not exceeding 7 days, or both; and


(c) upon a third (or more) conviction(s), be liable to a fine not exceeding $5000.00 or to closure for a period not exceeding 90 days, or both. [P.L. 1994-107, §3] [Penalty in Subsection (1) amended by P.L. 2004-9]


§204. Repealer.


Any provisions of the Alcoholic Beverage Control Act 1971, as amended, 21 MIRC 1, and any provisions of relevant local ordinances, rules or regulations which are inconsistent with the foregoing, are hereby repealed. [P.L. 1994-107, §4.]
