THE COUNCIL OF STATE, PERFORMING IN ACCORDANCE WITH THE CONSTITUTION THE FUNCTIONS OF TE BERETITENTI

AN ACT TO AMEND THE WORKMEN’S COMPENSATION
ORDINANCE (CAP 02)

Commencement:
1994


MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.

Short title

1. The Act may be cited as the Workmen’s Compensation (Amendment) Act No. 3 of 1994.

Interpretation

2. In this Act unless the context otherwise requires –

"principal Act" means the Workmen’s Compensation Ordinance (Cap. 102).


Amendment of section 6

1. Section 6 of the principal Act is amended in paragraph (a) as follows –

(a) (i) by deleting the figures "$12,500" occurring in the third line and substituting the new figures "$25,000";

(ii) by deleting the figures $1,500 occurring in the sixth line and substituting the figures "$250".

(b) in paragraph (c) by deleting the figures "$50" occurring in the fourth line and substituting the new figures "$250".


Amendment of section 7

2. Section 7 of the principal Act is amended in subsection (1) as follows –

(i) by repealing the figures "$12,500" occurring in the third line and substituting the new figures "$25,000"; and

(ii) by repealing the figures "$1,500" and substituting the new figures "$5,000".

WORKMEN'S COMPENSATION (AMENDMENT) ACT

EXPLANATORY MEMORANDUM


The main purpose of this Act is to amend sections 6 and 7 of the Workmen’s Compensation Ordinance (Cap. 102) to increase the compensation payable in cases where death results and in cases of permanent total incapacity.


This increase is necessary due to the inflation and increase in the cost of living since the ordinance came into force.

The amendment includes the Republic and it will particularly benefit Kiribati seamen and their dependents whose insurance benefits are linked to the benefits under the Workmen’s Compensation Ordinance.
