AN ACT TO AMEND THE SPECIAL FUND (GOVERNMENT
SUPPLIES)
ACT 1985 (NO. 4 OF 1985)

MADE by the Maneaba ni Maungatabi) and assented to by the Beretitenti.

Short title

1. This Act may be cited as the Special Fund (Government Supplies) (Amendment) Act 1986.

Interpretation

2. In this Act, unless the context otherwise requires-

"Supply Division" means the department or agency of the Government responsible for the procurement, provision and maintenance of Government supplies.

Amends section 4 of Act No. 4 of 1985

3. The Special Fund (Government Supplies) Act 1985 (No. 4 of 1985) is amended in section 4 by –
(a) renumbering section "4" as section "4(1)"; and
(b) by adding at the end of the renumbered section 4(1) a new subsection "(2)" to read as follows –
"(2) Without prejudice to subsection (1) hereof and for the avoidance of doubt–
(a) any monies in the possession of the Supply Division and being applied for the procurement, provision and maintenance of Government supplies immediately prior to the commencement of this Act; and
(b) the value of any assets or properties in the possession of the Supply Division immediately prior to the commencement of this Act,
shall be deemed to form part of the Special Fund".

(AMENDMENT)
ACT 1986

EXPLANATORY MEMORANDUM

The object of this Act is to amend the Special Fund (Government Supplies) Act 1985 so as to formally make available all monies and other assets or properties presently held by the Government Supply Division of the Ministry of Finance to the Government Supply Fund established by section 3 of that Act.

Section 5 of the Special Fund (Government Supplies) Act 1985 provides among other things that the amount of any expenditure by the Republic on the procurement, provision and maintenance of Government supplies shall be paid out of the said Fund.

It is therefore necessary that all monies and other assets and properties presently in the hands of the Government Supply Division (which is responsible for the procurement, provision and maintenance of Government supplies) should be made available to the said Fund in order to regularise and otherwise harmonise the accounting procedures of the Government Supply Division with the provisions of the Special Fund (Government Supplies) Act 1985.
