Salaries and Allowances of Members of the Maneaba ni Maungatabu (Amendment) Act 1990

AN ACT TO AMEND THE SALARIES AND ALLOWANCES OF MEMBERS OF THE MANEABA NI MAUNGATABU ACT (CAP. 92A);
AND FOR CONNECTED PURPOSES

MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.

Short title and commencement

1. (1) This Act may be cited as the Salaries and Allowances of Members of the Maneaba ni Maungatabu (Amendment) Act 1990.

(2) Subject to subsection (3) this Act shall come into operation on 1 January 1991.

(3) (a) Section 3(a)(i), (b)(i), (c)(i) and (d)(i) shall be deemed to have come into operation on 1 January 1989.

(b) Section 3(a)(ii), (b)(ii), (c)(ii) and (d)(ii) shall come into operation on 1 January 1991.


Interpretation

2. In this Act unless the context otherwise requires -

"the principal Act" means the Salaries and Allowances of Members of the Maneaba ni Maungatabu Act (Cap. 92A) as amended by the Salaries and Allowances of Members of the Maneaba ni Maungatabu (Amendment) Act 1986 (Act No. 14 of 1986).


Amendment of Schedule to principal Act

3. The Schedule to the principal Act is hereby amended in the second column (which relates to salary) by repealing -

(a) the figures "10294" and substituting the figures

"(i) 10808; and

(ii) 11457";

(b) the figures "9693" and substituting the figures

"(i) 10177; and

(ii) 10788";

(c) the figures "9108" and substituting the figures

"(i) 9563; and

(ii) 10137";

(d) the figures "5766" and substituting the figures

"(i) 6169; and

(ii) 6663".


Amendment of section 4 of principal Act

4. Section 4(1)(c) of the principal Act is hereby amended by repealing -

(a) paragraph (i) and substituting the following -

"(i) to business class air travel"; and

(b) paragraph (iii) and substituting the following -

"(iii) to business class air travel for his or her spouse if accompanying him or her;".


Amendment of third column of Schedule

5. The Schedule to the principal Act is hereby amended in the third column (which relates to Entertainment Allowance) by the insertion of the figures "600" in relation to the office of "Elected Member" specified in the first column.

Amendment of Section 5 of the principal Act

6. Section 5 of the principal Act is hereby amended in subsection (2) by repealing the figures "$600" and substituting the figures "$840".

Amendment of section 6 of the principal Act

7. Section 6 of the principal Act is hereby amended by the repeal of subsection (1) and the substitution of the following -

"(1) A Member when on official business overseas shall be paid subsistence allowance on the same basis as a public officer entitled to Class B rate or on salary level 5 and above."


Amendment of section 7A of the principal Act

8. The principal Act is hereby amendment in section 7A(2) by -

(a) the deletion of the full stop at the end of paragraph (iii) and the substitution of a comma; and

(b) the addition of the following -

"(iv) free water supply up to $40 per month."


Amendment of section 9 of the principal Act

9. Section 9 of the principal Act is hereby amended by repealing the whole section and substituting the following -

"Clothing Allowance

9. (1) A Member travelling overseas on official business shall be entitled to be paid a clothing allowance on the same basis as a public officer.

(2) Where such Member is accompanied by his or her spouse, the spouse shall also be entitled to such allowance.

(3) The allowance referred to in this section shall be paid only once in every 3 years".


Amendment of section 10 of the principal Act

10. Section 10 of the principal Act is hereby amended in the proviso by the repeal of the figure "$25" and the substitution of the figure "$50".

SALARIES AND ALLOWANCES OF MEMBERS OF THE MANEABA NI MAUNGATABU (AMENDMENT) ACT 1990

EXPLANATORY MEMORANDUM


The purpose of this Act is to amend the Salaries and Allowances of the Members of the Maneaba ni Maungatabu Act 1980 (Cap. 92A) as amended by the Salaries and Allowances of Members of the Maneaba ni Maungatabu (Amendment) Act 1986.

The amendments as outlined in this Act are based on the recommendations of the Maneaba Members' Salary Tribunal appointed on 3rd January 1989 (following a resolution of the Maneaba passed on 16 December 1988 for the purpose) with certain modifications considered by the Government to be reasonable and necessary under the circumstances.

This Act therefore essentially seeks to implement the said recommendations as modified and are as follows -

1. Sections 1 to 3 provide for -

(a) a 5% increase in the existing salaries of the Beretitenti and Ministers and a 7% increase in the existing salaries of Private Members of the Maneaba ni Maungatabu with effect from 1 January 1989. These increases reflect the salary increases awarded in 1989 to all public employees; and

(b) a further rise of 6% in the salaries of the Beretitenti and Ministers and a rise of 8% in the salaries of Private Members as increased pursuant to (a) above to take effect from 1 January 1991. These increases are in line with further public service salary increases already approved for 1991.


2. Section 4 seeks to substitute business class air travel for the existing economy class air travel as the entitlement of Private Members of the Maneaba ni Maungatabu and their spouses (where applicable) when they are on official visits overseas.

3. Section 5 seeks to provide that Private Members of the Maneaba shall be entitled to an Entertainment Allowance of $600 per annum while section 6 seeks to increase the motor car allowance of Ministers from $600 per annum to $840 per annum.

4. Section 7 provides that the subsistence allowance of a Private Member of the Maneaba when on official visit overseas shall be on the same basis as a public officer entitled to Class B rate or on salary level 5 and above.

5. Section 8, on the other hand, provides that the Kauoman-ni-Beretitenti shall now be entitled to free water supply up to $40 per month.

6. Section 9 seeks to extend the clothing allowance payable to a Private Member of the Maneaba travelling overseas on official business, to his or her spouse, if accompanying him or her. However, the same section also limits the payment of such allowance to only once in every 3 years.

7. Section 10 seeks to increase the cost or value of telephone calls which a Private Member of the Maneaba is entitled to make per year to $50 (from $25) as an alternative to 100 calls per year whichever is the less.
