Salaries and Allowances of Members of the Maneaba ni Maungatabu (Amendment) Act 1986

AN ACT TO AMEND THE SALARIES AND ALLOWANCES OF MEMBERS OF THE MANEABA NI MAUNGATABU ACT (CAP 92A)

Commencement: 24/12/1986


MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.

Short title and commencement

1. (1) This Act may be cited as the Salaries and Allowances of Members of the Maneaba ni Maungatabu (Amendment) Act 1986.

(2) Subject to subsection (3) of this section this Act shall come into operation on 1 January 1987.

(3) (a) Section 2(a)(i), (b)(i), (c)(i) and (d)(i) of this Act shall be deemed to have come into operation on 1 January 1982; and

(b) Section 2(a)(ii), (b)(ii), (c)(ii) and (d)(iii) shall be deemed to have come into operation on 1 January 1985.


Amends Schedule

2. The Schedule to the Salaries and Allowances of Members of the Maneaba ni Maungatabu Act (in this Act referred to as "the principal Act") is amended in the second column (which relates to salary) by repealing –

(a) the figures "8652" and substituting the following figures –

"(i) 9085;
(ii) 9358;
(iii) 10294;" and

(b) the figures "8,148" and substituting the following figures –

"(i) 8555;
(ii) 8812;
(iii) 9693;" and

(c) the figures "7656" and substituting the following figures –

"(i) 8039;
(ii) 8280;
(iii) 9108;" and

(d) the figures "4800" and substituting the following figures –

"(i) 5040;
(ii) 5242;
(iii) 5766;".


Amends section 4

3. Section 4 of the principal Act is amended –

"(1) in subsection (1) by repealing the whole subsection (1) and substituting the following subsection (1) –

(a) the Beretitenti shall be entitled –

(i) to first class air travel;

(ii) where the Government considers it necessary to do so, to be accompanied by his wife on not more than 3 occasions per year;

(iii) to first class air travel for his wife when accompanying him;

(iv) to be paid a subsistence allowance for his wife when accompanying him on the same basis as a public officer; and

(b) a Minister shall be entitled –

(i) to first class air travel;

(ii) where the Government considers it necessary to do so, to be accompanied by his wife on not more than one occasion per year;

(iii) to first class air travel for his wife when accompanying him;

(iv) to be paid a subsistence allowance for his wife when accompanying him on the same basis as a public officer; and

(c) any other member shall be entitled –

(i) to economy class air travel;

(ii) where the Government considers it necessary to do so, to be accompanied by his wife on not more than one occasion during the term of his office;

(iii) to economy class air travel for his wife when accompanying him;

(iv) to be paid subsistence allowance for his wife when accompanying him on the same basis as a public officer."


(2) By adding the following subsection (6) and (7) after subsection (5) –

"(6) When on official visits to his island constituency – the Beretitenti and a Minister shall be entitled –

(a) to free sea or air passage;
(b) to be accompanied by his wife on not more than two occasions per year;
(c) to be accompanied by his children on not more than one occasion per year;
(d) to free sea or air passage for his wife when accompanying him; and
(e) to free sea or air passage for any of his children when accompanying him the total amount of which such sea or air fare in respect of such passage shall not exceed 2 adult sea or air fares.

(7) In this section "child includes a stepchild or adopted child who has not attained the age of 18 years."


Amends section 5

4. Section 5 of the principal Act is amended –

(a) in subsection (2) by repealing the figures "$480" and substituting the figures "$600";

(b) by adding the following subsection (3) –

"(3) Where a Minister does not receive a car allowance under subsection (2) of this section he shall be entitled to a suitable official motor car for transport wherever he is engaged on any official business or duty of his office; and

(c) by adding the following subsection (4) –

"(4) In this section "official business or duty does not apply to any .....
