AN ACT TO AMEND THE SHIPPING ORDINANCE
(CAP. 93)

Commencement: 29/12/1981

MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.

Short Title

1. This Act may be cited as the Shipping (Amendment) Act 1981.

Amends S.23(1) of the principal Ordinance

2. Section 23(1) of the principal Act is amended by substituting a comma for the colon after the word ‘section’ in the fifth line, and by adding after the said word ‘section’ the following words, "and such fee as may be prescribed for such licence has been paid".

THE SHIPPING (AMENDMENT) BILL 1981

EXPLANATORY MEMORANDUM

1. Section 23 of the Shipping Ordinance Cap. 93 provides for the issue of a trading licence in respect of a vessel used within Kiribati for the purposes of trade or passenger traffic.

2. The said subsection makes no requirement for a fee to be paid for the issue of such licence.

3. In order that the Marine Superintendent in issuing a licence may require such fee as may be prescribed to be paid, S.23(1) of Cap. 93 has been amended to require payment of such fee.

4. Without such amendment, the Marine Superintendent has no authority to charge a fee under S.23.

5. The amended S.23(1) brings it into accord with S.22 which requires payment of a licence fee in respect of a ‘foreign going vessel’.
