AN ACT TO AMEND THE PROVIDENT FUND
ORDINANCE (CAP. 78A)

Commencement:
1997

MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.

Short title

1. This Act may be cited as the Provident Fund (Amendment) (No 2) Act 1997.

Commencement

2. Section 4 shall be deemed to have come into operation on 7 July 1997.

Amendment of section 5

3. Section 5 of the Provident Fund Ordinance (Cap. 78A) as amended by the Provident Fund (Amendment) Act 1982 (No 3 of 1982) is amended in subsection (1) -

(a) by repealing in paragraph (i) the words "after consultation with the Public Service Commission"; and

(b) by repealing in paragraph (iii) the words ", acting on the recommendation of the Public Service Commission"; and

(c) by repealing in paragraph (iv) the words ", acting on the recommendation of the Public Service Commission"; and

(d) by repealing paragraph (v).

Amendment of Section 28

4. Section 28 of the Provident Fund Ordinance (Cap. 78A) as amended by the Provident Fund (Amendment) Act 1997 (No. 10 of 1997) is amended in subsection (1) by repealing in paragraph (a) the word "and" at the end of that paragraph and substituting the word "or".

THE PROVIDENT FUND (AMENDMENT) (NO. 2) ACT 1997

EXPLANATORY MEMORANDUM

This Act seeks to amend the Provident Fund Ordinance so that the Public Service Commission will no longer be required to make recommendations to or be consulted by the Board of the Fund regarding employees of the Fund.

This is achieved in clause 3 by deleting the words "after consultation with the Public Service Commission" and "acting on the recommendation of the Public Service Commission" in section 5(1) of the Provident Fund Ordinance.

Clause 4 corrects an error in section 28 of the Ordinance as amended in the Provident Fund (Amendment) Act 1997.
