Short title and application


1. (1) This Ordinance may be cited as the Registration of Aliens Ordinance.


(2) This Ordinance shall not extend to Canton Island or Enderbury Island.


Interpretation


2. In this Ordinance unless the context otherwise requires -


"alien" means a person of the age of 16 years or over who is not a British subject, a British protected person or a citizen of the Republic of Ireland;


"registration officer" means a registration officer appointed under section 5.


Registration by aliens arriving in the Gilbert Islands


3. (1) Every alien who arrives in the Gilbert Islands shall make application for registration in the manner set out in section 4 within 28 days of the date of his arrival.


(2) Every person who becomes an alien as herein defined whether by attaining the age of 16 years or otherwise howsoever shall within 28 days make application for registration in the manner set out in section 4.


Application for registration Schedule


4. (1) Every application for registration shall be in writing in duplicate, in the Form A in the Schedule, and shall be made by delivering the same personally to an administrative officer or to the officer in charge of a police station who shall issue a receipt to the applicant as in Form B in the Schedule.


(2) Every such application shall be signed by the applicant in person with his usual signature, unless he is unable to write, in which case he shall, in the presence of the administrative officer or of the police officer to whom application is made, affix to the application such thumb print or finger prints or other means of identification as the administrative officer or police officer may require.

5. The administrative officer or police officer to whom the application is made shall, upon receipt thereof, forward the same registration to the person appointed by the Governor to be the registration officer for the district in which the applicant resides.

6. The registration officer shall file the application in his office and issue a certificate of registration in the Form C in the Schedule, 1 copy of which shall be retained in his office, 1 copy forward to the Governor with the duplicate of the application, and 1 copy delivered to the alien on his application at the place where his application for registration was delivered.


Notice to be given of change of abode or departure


7. (1) Every alien who after receipt of his certificate of registration shall change his place of abode shall within 14 days of such change notify an administrative officer or officer in charge of the police station nearest to his new place of abode.


(2) Every alien who after receipt of his certificate of registration is about to leave the Gilbert Islands shall notify an administrative officer or the officer in charge of the police station nearest to his place of abode of his intention to leave the islands.


Register of Aliens


8. The Governor shall cause to be compiled a register of the names, place of abode, and such other particulars as he may deem it expedient to include, of all registered aliens, to be called the Register of Aliens, which shall be amended from time to time by correcting errors therein, by adding thereto the names of aliens to whom certificates of registration have been issued, and by removing therefrom the names of aliens who die, or who leave the Gilbert Islands, or who otherwise cease to be subject to the provisions of this Ordinance.

9. (1) The Register of Aliens shall not be open as of right to inspection by any person.


(2) Notwithstanding the provisions of subsection (1) the court may in any proceedings for an offence under this Ordinance order or permit a certified copy of any entry in the Register to be produced in court.


(3) Any certificate of registration issued under the provisions of this Ordinance shall be prima facie evidence of the registration of the person to whom such certificate relates.


(4) A copy certified by the Governor or by an officer acting on his behalf of any entry in the Register shall be prima facie evidence of entry.


(5) A certificate under the hand of the Governor or of an officer acting on his behalf, or the absence of any entry in the Register shall be prima facie evidence of the facts stated in such certificate.


(6) The absence of an entry in the Register relating to any person shall be prima facie evidence that no application for registration has been made by that person.


(7) Judicial notice shall be taken of the signature of the Governor or of an officer acting on his behalf to any certificate or certified copy referred to in this Ordinance and the signature of a registration officer to any certificate of registration.


Offences


10. Any person who fails to comply with the provisions of sections 3, 4 or 7 or who in any application for registration wilfully makes any false statement shall be liable to a fine of $100 and to imprisonment for 6 months.


Power to exempt


11. The Governor may direct that any person or class of persons shall be exempt either unconditionally or subject to such conditions as the Governor may impose from all or any of the provisions of this Ordinance.
