An Ordinance to regulate the importation of animals and for matters incidental thereto

Commencement. Part III - 17th July 1919;
Remainder - 3rd June 1964

PART I

PRELIMINARY


Short title

1. This Ordinance may be cited as the importation of Animals Ordinance.

Interpretation

2. In this instance, unless the context otherwise requires -

"animal" means any animal except the human animal and includes birds, reptiles, fish and the young and eggs of any thereof and the carcase of any animal;

"carcase" means the carcase of an animal and includes part of a carcase, and the meat, bones, hide, skin, hooves, offal or other part of an animal, separately or otherwise, or any portion thereof;

"fodder" means hay or other substance commonly used for food of animals;

"imported" means brought or caused to be brought within the Gilbert Islands;

"inspector" means a person for the time being appointed by the Minister to be an inspector for the purposes of this Ordinance;

"litter" means straw or other substance commonly used for bedding or otherwise for or about animals;

"port" includes any aerodrome as defined in section 2 of the Aerodromes and Air Navigation Aids Ordinance;

"vessel" means and includes anything made or used for the conveyance by water of human beings or of property whatsoever and any aircraft of any description.

PART II

GENERAL PROVISIONS


Regulations

3. (1) The Minister may make regulations -

(a) prescribing the ports and parts of ports at which imported animals may be landed;

(b) defining parts of ports;

(c) prohibiting or regulating the movement of imported animals into, in or out of a defined part of a port;

(d) prohibiting or regulating the landing of imported animals, or of any specified kind thereof, or of carcases, fodder, litter, dung or other thing brought from any specified country or from any specified part thereof;

(e) prescribing and regulating the inspection and the examination and the mode, time and conditions of slaughter of imported animals in a defined part of a port;

(f) prescribing and regulating the seizure, detention, quarantine, isolation or destruction of any imported animal carcase, fodder, litter or dung;

(g) prescribing and regulating the treatment of animals to which this Ordinance or the regulations made under this Ordinance apply;

(h) prescribing fees and charges for any services rendered in respect of animals to which this Ordinance or the regulations made under this Ordinance apply.


(2) If any person without lawful authority or excuse, the proof whereof shall lie on him, commits any breach of any regulations made in exercise of the powers conferred by the preceding sub-section, or if he refuses to an inspector or other officer acting in execution of this Ordinance, or of regulations made under it, admission to any place or vessel which the inspector or other officer is entitled to enter or examine, or obstructs or impedes him in so entering or examining, or otherwise in any respect obstructs or impedes an inspector or other officer in the execution of his duty under this Ordinance, or assists in any such obstructing or impeding, he shall be liable to a fine of $40.

Minister may appoint inspectors

4. The Minister may appoint from time to time so many inspectors as he may think necessary for the purposes of this Ordinance and may assign to them their duties and salaries or allowances.

Inspector may enter suspected place or vessel

5. An inspector may at any time enter any place or vessel in which or in respect whereof he has reasonable grounds for supposing that this Ordinance or a regulation made under this Ordinance has not been or is not being complied with.

Vessel may be detained

6. Where an inspector is satisfied that this Ordinance or a regulation made under this Ordinance has not been or is not being complied with on board a vessel in a port, then upon the representation in writing to that effect of such inspector stating particulars of non-compliance such vessel may be detained by any officer of the customs until the Minister shall other wised direct.

Penalty in case of vessel proceeding after service of order for detention

7. The officer detaining the vessel shall forthwith serve the master of the vessel with a copy of the representation, and if the vessel after such detention or after service on the master of any notice of or order for such detention proceeds before it is released by competent authority, the master of the vessel, and also the owner and any person who orders the vessel to proceed if such owner or person be party or privy to the offence, shall be liable to a fine of $200.

Penalty in case of vessel so proceeding with officer onboard authorised to detain vessel

8. Where a vessel so proceeding takes, when on board thereof in the execution of his duty, any officer authorised to detain the vessel, the owner and master of the vessel shall each be liable to pay all expenses of and incidental to the officer being so taken, and also to a fine of $20 for every day until the officer returns or until such time as would enable him after leaving the vessel to return to the port from which he is taken, and such expenses may be recovered like manner as the fine.

Penalties for receiving, etc., certain animals

9. Any person who knowingly or wilfully receives, purchases or sells any animals landed or unshipped in contravention of this Ordinance or any regulation made thereunder shall be liable to imprisonment for 6 months and to a fee of $200.

Importation from specified country may be prohibited

10. Notwithstanding anything contained in this Ordinance the Minister may by notice restrict or absolutely prohibit for any specified time the importation of any animals, carcases or eggs or articles containing any portion of a carcase or egg, whether in raw state or cooked, preserved or otherwise treated or processed, from any other country in which there is reason to believe any infectious or contagious disease in animals exists.

PART III

SPECIAL PROVISIONS RELATING TO DOGS


Importation and licence

11. (1) No dog shall be imported except by way of one of the appointed ports of entry.

(2) Any person wishing to import a dog shall apply for a licence to an inspector and shall produce to such inspector a certificate purporting to be signed by a Government veterinary officer of the country from which the dog is being imported bearing a date within 2 months immediately prior to the date of intended importation of the dog and certifying that such dog has been examined by him and is free from all disease.

(3) If the inspector is satisfied that the certificate is in order he shall on payment of the prescribed fee issue a licence authorising the importation of the dog.

(4) For every such licence there shall be paid to the inspector for the credit of the Consolidated Fund a fee of 50 cents.

Minister may prohibit importation from certain places

12. The Minister may prohibit by notice the importation of dogs from any place mentioned in the notice.

Power to order destruction of dogs

13. An inspector may destroy or cause to be destroyed, without payment of compensation to the owner or importer thereof, any dog which in his opinion is suffering from rabies or from any contagious or infectious disease.

Penalty

14. Any person -

(1) importing a dog contrary to the provisions of this Part; or

(2) importing a dog from any place prohibited in the manner provided in section 11; or

(3) failing to comply with the conditions of any licence issued under this Part; or

(4) in any way obstructing or interfering with an inspector in the performance of his duties,


shall be liable to a fine of $100 and in default of payment to imprisonment for 6 months,

Saving for other laws

15. The provisions of this Ordinance shall be in addition to other laws and not in derogation of the provisions of any other laws for the time being in force in the Gilbert Islands relating to or affecting the importation of animals with respect to which this Ordinance applies.

Citation

1. These Regulations may be cited as the Importation of Animals Regulations.

Interpretation

2. In these Regulations, unless the context otherwise requires -

"cattle" includes any bull, cow, ox, steer, heifer or calf and the carcase or any portion of the carcase thereof respectively;

"the Chief Agricultural Officer" means the Chief Agricultural Officer of the Gilbert Islands;

"domesticated animal" includes horses, cattle, sheep, goats, dogs, cats and swine;

"domesticated poultry" includes fowls, ducks, turkeys, geese, pigeons, guinea fowls, pea fowls and the carcase, young or eggs of any thereof;

"horse" includes any horse, mare, gelding, colt, filly, foal, ass or mule or the carcase or any portion thereof respectively;

"infected animal" includes any animal which has been exposed to the infection of disease or any animal from countries from which their importation is prohibited by these Regulations;

"official veterinarian" means any veterinarian employed in an official capacity by any central or local government authority;

"owner" includes the person in charge for the time being;

"port of entry" means any of the ports specified for the landing of animals under regulation 4;

"sheep" includes any ram, ewe, wether or lamb and the carcase or any portion of the carcase thereof respectively;

"swine" includes any boar, farrow, sow or pig of any age or breed or the seed or the carcase or any portion thereof respectively;

"undomesticated animals" means all living animals not included under the definition of domesticated animal or poultry;

"vermin" includes ticks, lice, Melophagus ovinus, sheep scab, fleas and other skin parasites;

"veterinarian" means any person holding the diploma of the Royal College of Veterinary Surgeons, London, or a qualified veterinarian holding some other degree or diploma which is approved by the Chief Agricultural Officer for the purpose of these Regulations.


Importation of animals

3. The importation of any animal or fittings or other things which have animal manure or of any fodder, litter, fittings or other things which have or may have come into contact with any animal is absolutely prohibited except where such introduction takes place in accordance with these Regulations:

Provided that these Regulations shall not apply to any carcase manufactured into an article of commerce which has been properly sterilised in the manufacturing process or to any carcase imported from a country from which the live animal from which the carcase is derived may be imported under these Regulations.

Ports of entry

4. Save with the express authority in writing of the Chief Agricultural Officer, such animals as may by these Regulations be introduced into the Gilbert Islands shall be imported only through the ports of Betio and those at Ocean Island and Christmas Island and the airports at Bonriki and Christmas Island or such other ports or airports as may from time to time be designated by the Minister.

Notice of Arrival

5. The importer of any animal shall obtain, not less than 1 month prior to the advertised date of arrival of the vessel by which it is intended to import the arrival animal (or within such shorter period as the Chief Agricultural Officer, acting in his discretion, may allow), the written permission of the Chief Agricultural Officer to import the same:

Provided that animals imported for immediate slaughter shall be exempt from the provisions of this Regulation.

Declarations, etc., to be forwarded

6. The shipper of any imported animal or animals to be imported shall forward by the master of the vessel in which the same are conveyed to the Gilbert Islands with any such animal, to be delivered to the inspector at the port of entry, such declarations, certificates, notices and permits as are provided for by these Regulations.

Importation of horses, etc., and documents to accompany shipments thereof

7. Subject to the provisions of these Regulations, horses, asses or mules may be introduced into the Gilbert Islands from Fiji, New Zealand, New South Wales, Victoria, South Australia, Tasmania and the United Kingdom and each shipment of such animal shall be accompanied by -

(a) a statutory declaration by the shipper giving a description of the animal and certifying -

(i) that the animal has been free from disease during the 6 months preceding the date of shipment;

(ii) that it has not been in contact with any diseased animal during the 6 months next preceding shipment and giving the name of the district in which it has been during that time; and

(b) a certificate by an official veterinarian in the country from which such animal was shipped that he has examined the animal within 7 days of the date of shipment and found it to be free from vermin and any symptoms of any disease and, in the case of any such animal from the United Kingdom, that he has satisfied himself that a properly applied Mallein test on the animal within 30 days prior to such date of shipment gave a negative result.


Importation of cattle

8. Subject to the provisions of these Regulations, cattle may be introduced into the Gilbert Islands from New Zealand, Fiji, Tasmania, New South Wales, Victoria, South Australia and the United States of America.

Documents to accompany imported cattle

9. In the case of cattle the importation of which is provided for in the preceding Regulation, each shipment of any such animal shall be accompanied by -

(a) a statutory declaration by the shipper giving a description of the animal and certifying -

(i) that the animal has been free from disease during the 6 months next preceding the date of shipment;

(ii) that it has not been in contact with any diseased animal during the 6 months next preceding the date of shipment and giving the name of the district in which it has been during that time;

(iii) that it has not otherwise than is required by paragraph (b) been tested with tuberculin during the 2 months next preceding shipment or inoculated with pleuro-pneumonia virus at any time;

(b) a tuberculin test certificate by an official veterinarian or by a veterinarian endorsed by an official veterinarian of the country or district concerned. The certificate shall state (inter alia) the date on which the test was applied; and

(c) a certificate from an official veterinarian stating -

(i) that he has examined the animal within 7 days of shipment and found it to be free from disease;

(ii) that it has been dipped or thoroughly sprayed within 36 hours of shipment with a standard anti-tick solution, the name of the solution to be given; and

(iii) that the agglutination test for contagious abortion has been applied with negative results within 14 days of the date of shipment;

(iv) that contagious bovine pleuro-pneumonia neither is, nor during the 6 months next preceding the shipment of the animal has been, declared or known to exist in the district from which the animal is declared by the owner to have been exported or in which it has been during the 6 months next preceding shipment;

(v) that the animal comes from a district free from infestation with the cattle tick (Boophilus australis).


Importation, of dogs, cats, sheep, goats and swine

10. Subject to the provisions of these Regulations, dogs, cats, sheep, goats and swine may be introduced into the Gilbert Islands from New Zealand, Fiji, New South Wales, Victoria, Tasmania and South Australia and each shipment of any such animal shall be accompanied by -

(a) a statutory declaration by the shipper setting forth the kind, number, sex, marks or brands thereof and certifying -

(i) that the animal has been free from disease during the 6 months next preceding the date of shipment;

(ii) that it has not been in contact with any animal suffering from disease during the 6 months next preceding the date of shipment and giving the name of the district in which it has been during that time;

(b) a certificate by an official veterinarian stating -

(i) that he has examined the animal within 7 days of the date of shipment and found it to be free from disease and vermin; and

(ii) that it has been dipped or thoroughly sprayed within 36 hours of shipment with a standard anti-tick solution, the name of the solution to be given; and

(c) an endorsement by such official veterinarian on the shipper's declaration that after due inquiry he has no reason to doubt the correctness of such declaration.


Undomesticated animals

11. (1) Before any shipment of undomesticated animals is made a permit must be obtained from the Chief Agricultural Officer by the person intending to introduce them into the Gilbert Islands.

(2) Every shipment of such undomesticated animals must be accompanied by -

(a) a statutory declaration made by the shipper setting forth -

(i) the kind, number, sex and marks of such undomesticated animals;

(ii) the location and environment of such animals during the six months immediately preceding shipment;

(iii) a declaration that such animals are at time of shipment free from disease and that they have been so during the next preceding 6 months and that during that time they have not been in contact with any diseased animals; and

(b) certificate by an official veterinarian stating that he has examined the animals within 7 days of the date of shipment and found them to be free from disease and vermin.


(3) An official veterinarian, after due inquiry, shall also endorse the shipper’s declaration to the effect that he has no reason to doubt its correctness.

Importation of poultry

12. Subject to the provisions of these Regulations, domesticated poultry may not be introduced into the Gilbert Islands from any place whatsoever:

Provided that this regulation shall not apply to -

(a) the importation of day-old chickens from Australia, Fiji or New Zealand;

(b) the importation from Fiji or New Zealand of live domesticated poultry (other than day-old chickens) in respect of which a certificate has been granted by an official veterinarian that inquiries made lead him sincerely to believe that during the 6 months immediately preceding the date of shipment such poultry has been free from disease and that either -

(i) such poultry have been subjected to a virus neutralisation test for Infectious Laryngo Tracheitis with negative results and that from the time of the application of such test such poultry has not been in contact with any other poultry; or

(ii) the disease of Infectious Laryngo Tracheitis is not present in the country from which such importation takes place;

(c) the importation from any country except China or Hong Kong of any poultry carcase or egg or part of a poultry carcase or egg which has been properly sterilised and hermetically sealed;

(d) the importation of manufactured animal manure in which all animal product ingredients have been properly sterilised and packed in tins or new bags; and

(e) the eggs or frozen carcase of any domesticated poultry when such eggs or carcases have been produced in Australia, New Zealand or Fiji and are intended for consumption as food in the Gilbert Islands.


Importation of eggs for incubation

13. (1) Every importation of eggs of domesticated poultry for incubation from Australia, New Zealand or Fiji shall be accompanied by a statutory declaration by the shipper that such eggs are from birds which have been found by means of the agglutination test for Salmonella pullorum to be free from the disease known as bacillary white diarrhoea and which have been produced on premises free from infection with the said disease during the 6 months immediately preceding the date of shipment.

(2) An official veterinarian shall endorse the shipper's declaration to the effect that after due inquiry he has no reason to doubt its correctness.

Procedure while prohibited animals are on the sea, etc.

14. (1) No animals the introduction of which into the Gilbert Islands is prohibited by these Regulations (whether such animals are intended for introduction into the Islands or not) shall be taken or allowed on board any vessel carrying an animal to the Islands while such latter animal is on board.

(2) No animal being carried to the Islands shall be taken or allowed on shore at any place from which the introduction into the Islands of animals of the same kind is prohibited.

(3) When a vessel on which there is any imported animal arrives in the Gilbert Islands the following provisions of this Regulation shall apply and remain in force while the vessel continues in Gilbert Islands waters, and the master of such vessel and the importer of such animal shall be generally liable for any breaches thereof.

(4) Such imported animal shall be kept securely confined on board until it is removed or otherwise disposed of by order or permission of an inspector. An inspector may order any animal intended for introduction into the Islands to be placed on a wharf in such a manner as to facilitate inspection but it shall in no case be turned loose on a wharf. Sheep and pigs shall be confined in temporary pens and cattle and horses shall be tied on such wharf. No animal of any description shall be allowed to leave the wharf whereon it has been placed for inspection until an inspector has issued a permit authorising the landing of such animal. In no case shall the removal of a live animal from a quarantine or other purpose constitute an entry into the Islands until an inspector is satisfied that it is free from infectious and contagious disease and has issued a permit allowing the introduction of the said animal.

(5) In the case of a ship's dog, or other ship's animal and of any animal intended for use on ships, such dog or animal shall be detained on board and held in such secure manner as is approved by an inspector or shall be disposed of as the Chief Agricultural Officer directs.

Animals on foreign-going vessels prohibited from landing unless authorised

15. (1) The master of any foreign-going vessel arriving in the Gilbert Islands from abroad having any animals on board shall not during such time as his vessel is in the Gilbert Islands allow the animal to leave the vessel but shall keep it on board such vessel unless and until an inspector has issued a permit authorising the importation thereof.

(2) No person shall take, or permit to be taken, any animal on board any foreign-going vessel on which there is any live animal the landing of which in the Islands has not been permitted by an inspector:

Provided that in the case of vessels arriving in the Islands from Fiji, Australia or New Zealand and having on board animals the importation of which may be permitted under these Regulations it shall be lawful for an inspector, acting in his discretion, to issue a licence for an animal to be taken on board such vessels, for a voyage between ports in the Islands.

Seizing, etc., of animal landing in contravention of Regulations

16. (1) The master of any foreign-going vessel who allows an animal to leave or to go aboard his vessel or any owner who takes an animal or allows it to go, or to be taken, on board a foreign-going vessel whilst in the Gilbert Islands except in accordance with these Regulations shall be liable to have the animal seized and destroyed or dealt with in such other manner as the Chief Agricultural Officer may deem expedient to direct and such master or owner (as the case may be) shall be liable to pay all expenses incurred in giving effect to any directions given under the provisions of this Regulation.

Death of animals whilst in port

17. In the event of any animal dying or escaping from any foreign-going vessel while the vessel is in any port in the Gilbert Islands, immediate notice of such death or escape shall be forwarded by the master of the vessel by telegraph or other expeditious means to the Chief Agricultural Officer. Any such animal that has died or any animal which has been landed in contravention of these Regulations shall be destroyed or otherwise dealt with as the Chief Agricultural Officer directs.

Master to report animal on board during the voyage, etc.

18. Immediately upon arrival at the first port of entry in the Gilbert Islands of any vessel on which there is or has been any animal, the master shall report details thereof to an inspector at such port and such inspector may go on board such vessel and inspect and examine all animals thereon.

Notice and declaration to be made on arrival of an animal

19. On arrival of any vessel on which there is any imported animal at the port at which such animal is to be landed the master of such vessel shall give notice of arrival to an inspector at the port and shall make, and tender to such inspector, a declaration stating -

(a) whether, to the best of his knowledge and belief, any animal on such vessel has been during the voyage or is at the present time infected with any disease or has died during the voyage;

(b) that no animal the introduction of which into the Gilbert Islands is prohibited is, or has been, on board such vessel since the shipment of any animal proposed to be landed in the Islands; and

(c) that during the voyage no animal to be landed in the Islands has been taken or allowed on shore at any place from which the introduction into the Islands of imported animals is prohibited.


At the same time such master shall deliver to the inspector all such other declarations and certificates as may be required to be so delivered under the provisions of these Regulations.

Release of animals

20. (1) If the inspector concerned is satisfied that the several declarations or certificates provided for by these Regulations are in order, that the provisions of the Ordinance and these Regulations have been complied with, and that all animals on the importing vessel are free from disease and are not infected animals, he shall issue an order in the prescribed form for the release of the animals sought to be imported to the consignee or his agent either unconditionally or subject to such restrictions and conditions as the Chief Agricultural Officer may see fit to impose.

(2) Before permitting the release of an animal under the preceding sub-regulation an inspector may require the importer to execute a bond with 2 approved sureties for ensuring that the importer thereof will faithfully carry out any conditions contained in, or imposed under these Regulations.

Power of destruction

21. If an inspector empowered by regulation 18 to inspect animals on any vessel on arrival in the Gilbert Islands reports that any animal on board is a diseased or infected animal, all the animals on board shall be destroyed or otherwise dealt with or disposed of as the Chief Agricultural Officer directs.

Certain fodder may be imported

22. The provisions of regulation 3 to the contrary notwithstanding, fodder arriving in the Gilbert Islands on a vessel bringing imported animals may lawfully be introduced into the Islands if such fodder is the product of the country or state from which the animals were shipped.

Disposal of clothing, harness, etc.

23. Clothing, fittings, utensils, crates or boxes, kennels, harness, saddlery, implements or any appliances or things used on any vessel in connection with any imported animals introduced into the Gilbert Islands may be destroyed, refused admission or, on the issue of a permit by the inspector, may be introduced into the Islands, provided however that such clothing, fittings, utensils, crates or boxes, kennels, harness, saddlery, implements or other appliances must, if allowed to be introduced, be subjected at the expense of the importer to such disinfection as the Chief Agricultural Officer deems necessary and directs.

Fees and costs
Schedule 1

24. (1) The fees set out in Schedule 1 shall be payable by the importer of any animal to the inspector who renders in respect of such animal the duty or service specified in the case of each respectively.

(2) The cost of dipping, spraying, testing or other treatment lawfully required under the provisions of these Regulations shall be borne by the importer.
