Traffic Act (Amendment) Decree 1991 (No.38)

TRAFFIC ACT (AMENDMENT) DECREE 1991
________

A DECREE TO AMEND THE TRAFFIC ACT

IN exercise of the powers vested in me as the President of the Sovereign Democratic Republic of Fiji and Commander-in-Chief of the Armed Forces and acting in accordance with the advice of the Prime Minister and the Cabinet, I hereby make the following Decree:

Short title and Interpretation

1.-(l) This Decree may be cited as the Traffic Act (Amendment) Decree 1991.

(2) In this Decree, the Traffic Act, Chapter l76, is referred to as the "Principal Act".

Section 86 of the Principal Act amended

2. Subsection (1) of Section 86 of the Principal Act is hereby amended by repealing paragraph 43 thereof and substituting therefore the following new paragraph, that is:

"43. Provision of safety devices in motor vehicles or any class of motor vehicles and requiring persons travelling in such vehicles to use the safety devices provided."

Saving Provisions

3.-(1) Without prejudice to section 19 of the Interpretation Act, subsidiary legislation made pursuant to the repealed paragraph 43 shall be deemed to have been made pursuant to and under the provision of the new paragraph 43 substituted by section 2 of this Decree and shall have full force and effect thereunder.

(2) Notwithstanding subsection (1), nothing in this Decree shall be deemed to make an offence act committed, or omission made, prior to the commencement of this Decree, which was not an offence under the subsidiary legislation made pursuant to the repealed paragraph 43.
