REVISED EDITION OF THE LAWS (AMENDMENT) ACT 1986

AN ACT


TO AMEND THE REVISED EDITION OF THE LAWS ACT


16th December, 1986


ENACTED by the Parliament of Fiji-


Short title


1.-(1) This Act may be cited as the Revised Edition of the Laws (Amendment) Act, 1986.


(2) In this Act, "principal Act" means the Revised Edition of the Laws Act.


Replacement of section 12


2. Section 12 of the principal Act is repealed and replaced by the following section-


"Revision of the revised edition


12.-(1) As soon as practicable after the 1st day of January in every year after the effective date, the Attorney-General shall, subject to subsections (2), (4) and (7)-


(a) cause to be prepared and published a new revised edition of any written law that has been amended during the period of twelve months ending on the preceding 31st day of December;


(b) cause to be published any new Act enacted during the said period, other than any Act the sole or substantial effect of which was to amend another Act;


(c) cause to be published all new subsidiary legislation made during the said period under any Act, other than subsidiary legislation the sole or substantial effect of which was to amend other subsidiary legislation;


(d) if he considers it necessary, cause to be prepared and published a new index to the revised edition, a new list of chapters and a new alphabetical list of chapters;


(e) if he considers it necessary or desirable, cause to be prepared and published a new revised edition of any written law omitted from the revised edition pursuant to subsection (2) of section 4.


(2) The Attorney-General shall not be required to prepare and publish a new revised edition of any written law that has been amended if he considers that the amendments are not sufficiently extensive to justify the preparation and publication thereof but all such amendments shall be published in replacement pages to be inserted in the revised edition in conformity with the instructions issued by the Attorney-General pursuant to subsection (3).


(3) The Attorney-General shall include, with any material published pursuant to this section, suitable instructions for the insertion of such material in the revised edition and for the removal of redundant pages.


(4) The Attorney-General may also include in any revision made pursuant to this section, written law enacted or made after the preceding 31st day of December, if he considers it convenient and useful so to do.


(5) With effect from such date as the Attorney-General may specify by Notice in the Gazette, and subject to the other provisions of this Act, the material comprising a revision of the revised edition prepared pursuant to this section shall, when inserted in the revised edition in conformity with the instructions issued by the Attorney-General under subsection (3), be deemed to be included in and to form part of the revised edition and as such and in place of any material removed in conformity with those instructions, shall without any question whatsoever in all courts of justice and for all purposes whatsoever be the sole and only proper law of Fiji in respect of the written law contained therein.


(6) The Attorney-General shall, before publishing any Notice under subsection (5), cause-


(a) a complete set of the revised edition, as revised pursuant to this section; and


(b) a complete set of the material published pursuant to this section, to be bound together in volumes in a permanent manner and shall transmit those sets, sealed on the title page of each volume with the Public Seal of Fiji, and signed by the Attorney-General, to the Chief Registrar of the Supreme Court to be retained by him for record purposes.


(7) For the purposes of this section the Attorney-General shall have and perform mutatis mutandis the powers and duties conferred or imposed by this Act on the Commissioner.".


Amendment of section 13


3. Section 13 of the principal Act is amended by repealing the expression "subsection (4)" and replacing it with the expression "subsection (5)".


Replacement of section 14


4. Section 14 of the principal Act is repealed and replaced by the following section-


"Distribution of revised edition


14. Copies of the revised edition compiled in the manner provided by section 7 and of the revised edition as revised pursuant to section 12 and of any material contained in a revision of the revised edition prepared in the manner provided by section 12 shall be-


(a) distributed without charge to such persons, officers, departments and institutions as the Attorney-General may direct; and


(b) offered for sale to the public in such planner, in such numbers and at such price as the Attorney-General may direct.".


Construction of references to repealed or amended written law


5. Section 15 of the principal Act is amended by repealing the words "any booklet published under section 12" and replacing them by the words "the revised edition as revised pursuant to section 12".


Replacement of section 16


6. Section 16 of the principal Act is repealed and replaced by the following section-


"Transitional


16. The powers conferred upon the Attorney-General by section 12 shall in relation to the period between the effective date and the 31st day of December 1985 be construed as if-


(a) the words "the first day of January in every year after" in subsection (1) of section 12 were deleted; and


(b) for the words "the period of twelve months ending on the preceding 31st day of December" in subsection (1) of section 12 there were substituted the words "the period commencing on the effective date and ending on the 31st day of December 1985".".
