AN ACT
TO AMEND THE ROTUMA ACT

(1 November 1992)


ENACTED by the Parliament of Fiji


Short title and commencement


1. - (1) This Act may be cited as the Rotuma (Amendment) Act, 1993 and shall be read together with and deemed part of the Rotuma Act (hereinafter referred to as "the principal Act").


(2) This Act shall be deemed to have come into force on the 1st day of November 1992.


Section 19 amended


2. Section l9 of the principal Act is amended at subsection (4) by substituting a colon for a full stop at the end of the subsection and by inserting the following proviso immediately thereafter:


"Provided that -


(a) if for any reason the election of representatives cannot take place as stipulated ,the Minister shall have the power to appoint to the Council one representative from each of the Rotuma districts to be members thereof and who shall be deemed together with the persons who shall be members of the Council by virtue of sub-section (1)(a) and (c) of Section 12, to be members of the Council and shall, subject to any general or specific directions issued by the Minister, have, perform and discharge all the rights, privileges, powers, duties and functions vested in or conferred or imposed on the members and the Council by the Act or any written law until the election of representatives takes place in the month of October next following;


(b) an appointment made in accordance with paragraph (a) shall be deemed terminated on the day the names of the newly elected representatives are declared;


(c) for the purpose of the next election of representatives after the election of representatives to be conducted in October, 1993, the three years period between which the elections are to be held, shall begin to run from the date of the last election of representatives due to take place in October, 1993.".
