AN ACT
TO AMEND THE PENAL CODE
ENACTED by the
Parliament of the Fiji Islands
Short title, etc
1. (1) This Act may be cited as the Penal Code (Penalties)
(Amendment) Act 2003.
(2) In this Act, the Penal Code (Cap. 17) is
referred to as the Code.
Section 33 replaced
2. The Code is amended by repealing section 33 and
substituting the following section
"Minimum period on sentence of imprisonment
33. Where an offence in any written law prescribes a maximum term of imprisonment of ten years or more, including life imprisonment, any court passing sentence for such offence may fix the minimum period which the court considers the convicted person must serve.".
Section 151 amended
3. Section 151 of the Code is amended by deleting seven
years and substituting ten years.
Section 155 amended
4. Section 155 of the Code is amended in subsection (2) by
deleting five years and substituting twelve years.
Section 156 amended
5. Section 156 of the Code is amended by deleting five
years and substituting ten years.
Section 159 amended
6. Section 159 of the Code is amended by deleting five
years and substituting twelve years.
Section 160 amended
7. Section 160 of the Code is amended by deleting two
years and substituting ten years.
Section 161 amended
8. Section 161 of the Code is amended by deleting two
years and substituting twelve years.
Section 162 amended
9. Section 162 of the Code is amended by deleting two
years and substituting twelve years.
Section 163 amended
10. Section 163 of the Code is amended by deleting two
years and substituting twelve years.
Section 170 amended
11. Section 170 of the Code is amended by deleting a
misdemeanour and substituting an offence and is liable to a fine not exceeding
$100,000 or to a term of imprisonment not exceeding five years or to both such
fine and imprisonment..
Section 171 amended
12. Section 171 of the Code is amended by deleting three
years and substituting ten years.
Section 178 amended
13. Section 178 of the Code is amended by deleting seven
years and substituting twenty years;
Section 179 amended
14. Section 179 of the Code is amended by deleting seven
years and substituting ten years.
Section 293 amended
15. Section 293 of the Code is amended in subsection (3)
by deleting five years and substituting ten years.
