AN ACT
TO AMEND THE PENAL CODE
ENACTED by the
Parliament of the Fiji Islands-
Short title, etc
1.- (1) This Act may be cited as the Penal Code
(Amendment) Act 2002 and comes into force on the date it is assented to by the
President.
(2) In this Act, the Penal Code (Cap. 17) is referred to as
the Code.
Code amended
2.- (1) The Code is amended-
(a) in sections 50 and 51 by deleting "shall be sentenced to death" and substituting "is liable on conviction to imprisonment for life.
(b) in section 69(2)(a) by deleting "be sentenced to death" and substituting "be liable to imprisonment for life".
(2) For the avoidance of doubt, this
Act applies to charges or proceedings under section 50, 51 or 69(2) of the Code
that are pending
at the commencement of this Act.
Consequential amendments
3. The Code is amended-
(a) in section 4 in the definition of "felony" by deleting ", with death, or";
(b) by repealing sections 24, 25, 26(2), 27(2) and 34(4)(b);
(c) in section 28(5) by deleting ", not being a sentence of death";
(d) in section 137(a) by deleting "death or" wherever it appears.
