AN ACT

TO AMEND THE POLICE ACT

ENACTED by the Parliament of Fiji-

Part 1-PRELIMINARY

Short title, etc.

1.-(1) This Act may be cited as the Police (Amendment) Act 1998.

(2) The Police Act (Cap. 85) is in this Act referred to as the Principal Act.

Commencement

2. This Act commences on a date appointed by the Minister and published in the Gazette.

Part 2-AMENDMENTS OF PRINCIPAL ACT

Interpretation

3. Section 2 of the Principal Act is amended-

(a) by inserting the following new definition-

"'Disciplined Services Commission' means the Disciplined Services Commission referred to in paragraph 142 (c) of the Constitution;"; and

(b) by omitting "Royal" from the definition of "Force".

Establishment of Force

4. Section 3 of the Principal Act is amended by omitting "Royal".

Enlistment

5. Section 9 of the Principal Act is amended by omitting "with the approval of the Minister".

Declaration on enlistment

6. Section 10 of the Principal Act is amended by omitting from subsection (2) "of Her Majesty's Forces or police" and substituting "other police or military force".

Discharge

7. Section 14 of the Principal Act is amended by omitting from subsection (1) "Police Service" and substituting "Disciplined Services".

Trial of offences against discipline

8. Section 32 of the Principal Act is amended by omitting from subsection (1) "Police Service" and substituting "Disciplined Services".

Dismissal and reduction in rank of police officers convicted by any court

9. Section 37 of the Principal Act is amended by omitting "Police Service" and substituting "Disciplined Services".

Passed by the House of Representatives this Seventeenth day of March, in the year of our Lord, One Thousand, Nine Hundred and Ninety-Eight.

Passed by the Senate this Sixth day of April, in the year of our Lord One Thousand, Nine Hundred and Ninety-Eight.
