AN ACT

TO AMEND THE PENSIONS ACT 1983

ENACTED by the Parliament of Fiji.

Short title and commencement

1.-(1) This Act may be cited as the Pensions (Amendment) Act, 1996.

(2) This Act shall come into force on a date appointed by the Minister and published in the Fiji Republic Gazette.

Interpretation

2. In this Act, the Pensions Act 1983 is referred to as "principal Act".

Section "28" amended

3. Section "28" of the principal Act is amended by:-

(a) inserting a new subsection as "(2A)" immediately after subsection "(2)" as follows:-

"(2A) For the avoidance of any doubt-

(a) paragraph (a) of subsection (2) of this Section shall not apply to any subordinate police officer or subordinate prison officer;

(b) paragraph (b) of subsection (2) of this Section shall not apply to any subordinate police officer or subordinate prison officer who, in consequence of his injury is awarded compensation under the Workmen's Compensation Act."

(b) inserting anew subsection as "(3A)" immediately after subsection "(3)" as follows:-

"(3A) For the avoidance of any doubt, subsection (3) of this Section shall not apply to any police special constable or temporary subordinate prison officer employed under subsection (4) or (5) of Section 11 of the Prisons Act who, in consequence of his injury is awarded compensation under the Workmen's Compensation Act."

Section "29" amended

4. Section "29" of the principal Act is amended by:-

(a) removing the full stop at the end, and inserting a colon;

(b) inserting the following proviso:

"Provided that this Section shall not apply to any subordinate police officer or subordinate prison officer or a special constable or any temporary subordinate prison officer employed in the Fiji Prisons Service under subsection (4) or (5) of Section 11 of the Prisons Act."

Section "37" amended

5. Section "37" of the principal Act is amended by inserting a new provision as subsection "(5)" as follows-

"(5) This Section shall not apply where in respect of an officer or soldier compensation has been paid under the Workmen's Compensation Act for injury or death."

Passed by the House of Representatives this Sixteenth day of September, in the year of our Lord, One Thousand, Nine Hundred and Ninety-Six.
