AN ACT TO PROVIDE FOR THE PAYMENT OF PENSIONS TO PERSONS, AND TO THE WIDOWS AND WIDOWERS OF PERSONS, WHO HAVE HELD THE OFFICE OF GOVERNOR-GENERAL

Short title


1. This Act may be cited as the Governor-General (Pensions) Act.


Governor-General's entitlement to a pension


2.-(1) Every person who, on or after 7 May 1982, ceases to hold the office of Governor-General shall be paid a pension under this section with effect from the date on which he ceases to hold that office until his death.


(2) The yearly rate of the pension payable to any person under this section shall be as follows, that is to say-


(a) where he has held the office of Governor-General for not more than two years, $3,000; and


(b) where he has held that office for more than two years-


(i) $3,000; and


(ii) in addition, $1,000 for each completed year that he has held that office following the expiration of those two years.


(3) Where a person has held the office of Governor-General on two or more separate occasions, the periods during which he held that office shall be aggregated from the purpose of calculating the yearly rate of the pension payable to him under this section.


(4) A person who is entitled to a pension under this section shall also be entitled with effect from the date on which he ceases to hold the office of Governor-General until his death, to an allowance payable from time to time to meet the cost of all charges and fees under the Telecommunications Act in respect of the installation, connection, maintenance and rental of a telephone, and any extensions thereof, in any private residence of his, and to meet the cost of all charges under that Act in respect of local calls originating from such telephone.

Entitlement to a pension of widow or widower of a Governor-General
or retired Governor-General


3.-(1) Subject to subsection (2), where a person dies, leaving a widow, while he was holding the office of Governor-General or after he had ceased to hold that office, a pension shall be paid to the widow with effect from the date of the death of that person until the death of the widow at a yearly rate equal to sixty per cent of the yearly rate of-


(a) in the case where that person died while holding the office of Governor-General, the pension to which he would have been entitled under section 2 had he ceased to hold office on the date of his death;


(b) in the case where he died after he had ceased to hold that office, the pension to which he was entitled under section 2 at the date of his death.


(2) A widow shall cease to be entitled to a pension under this section upon re-marriage.


(3) In this section "widow" includes a widower.


Further allowances


4.-(1) The Minister may authorise the payment to a person entitled to a pension under this Act of such further allowances as the Minister may deem fit.


(2) An allowance payable to any person under subsection (1) shall not form part of that person's entitlement to a pension under this Act unless the Minister so directs; and any such allowance in respect of which no direction has been given by the Minister under this subsection may be terminated or varied as and when the Minister shall determine.


General provisions


5.-(1) A pension or allowance payable under this Act to any person shall-


(a) be a charge on the Consolidated Fund;


(b) not be chargeable to basic tax or normal tax under the Income Tax Act; and


(c) be payable in addition to any other superannuation or other retiring allowance, and any capital sum in respect of retirement or by way of commutation of such an allowance, paid or payable to that person under any written law.

(2) The provisions of this Act shall not be taken to confer on any person entitlement to a pension or allowance under this Act otherwise than by reason that such person-


(a) was the substantive holder of the office of Governor-General; or


(b) is the widow or widower of a person who was the substantive holder of that office.
