An Act to amend the Prevention of Juvenile Crime Act 1968


(3 December 1997


BE IT ENACTED by the Parliament of the Cook Islands in Session assembled and by the authority of the same as follows:


1. Short Title and commencement - (1) This Act may be cited as the Prevention of Juvenile Crime Amendment Act 1997 and shall be read together with and deemed part of the Prevention of Juvenile Crime Act 1968 (hereinafter referred to as "the principal Act").


(2) This Act shall come into force on the date it is assented to by the Queen's Representative.


2. Constitution of Committee - The principal Act is amended by repealing section 5 and substituting the following new section -


"5. Constitution of Committee - (1) The Committee shall consist of three members comprising:


(a) one member to be appointed by the Solicitor-General, who shall be Chairperson; and


(b) one member appointed by the Minister; and


(c) the Commissioner of Police or his delegate.


(2) In the absence of any member, the Committee shall, so long as it has at least two members present, continue to hear any complaint as though it were a full Committee of three."


3. Appointment of Deputy Chairperson - The principal Act is further amended by inserting after section 5 of the Act the following new section -


"5A. Appointment of Deputy Chairperson - (1) The Solicitor-General shall appoint a Deputy Chairperson of the Committee who shall preside over the Committee hearings in the event that the Chairperson is unavailable.


(2) The Deputy Chairperson shall exercise all powers and functions of the Chairperson."


4. Transitional - (1) Notwithstanding the repeal of section 5 of the principal Act, the persons holding office as members of the Juvenile Crime Prevention Committee immediately before the coming into force of this Act, shall continue to hold office upon such terms and conditions that those persons were appointed immediately prior thereto.


(2) Where any reference is made to Chairman in the principal Act, it shall be read as Chairperson.
