An Act to amend the Medical and Dental Practices Act 1976


(21 March 1977


BE IT ENACTED by the Legislative Assembly in session, and by the authority of the same as follows:


1. Short Title - This Act may be cited as the Medical and Dental Practices Amendment Act 1977 and shall be read together with the deemed part of the Medical and Dental Practices Act 1976 (hereinafter referred to as "the principal Act").


2. Qualification for registration as medical or dental practitioner - Section 12 of the principal Act is hereby amended by adding a new subsection as follows:-


(2) Where the Council is satisfied that any medical or dental practitioner of good fame and character -


(a) Has attained eminence in his profession; or


(b) Is engaged in medical or dental work of actual or potential major importance in the advancement of health; or


(c) Being a Cook Islander, holds consultant status,


the council may, in its absolute discretion and on the application of the practitioner determine such practitioner to be entitled to be registered as a medical or dental practitioner as the case may be."


3. Qualification for registration as specialist - The principal Act is hereby further amended by inserting between section 12 and section 13 a new section as follows:


"12A. (1) Every person who is registered under this Act as a medical or dental practitioner shall be entitled to be registered as a specialist on satisfying the Council that he -


(a) Holds postgraduate qualifications in medicine or dentistry in the speciality from:


(i) Australia, Fiji, New Zealand, the Republic of Ireland or the United Kingdom; or


(ii) Any other country provided the Council is satisfied that the standard of such qualification is comparable to that of the other countries specified in the preceding subparagraph; or


(2) Every person entitled to be registered as a specialist shall be so registered by the Council on application by him for such registration and on payment of the fee prescribed in the Schedule to this Act."


4. Schedule - The Schedule to the principal Act is hereby amended by adding the following part after Part II:


"Part III Application for registration as specialist.
