An Act to Amend the Civil List Act 1968

(12 December 1980

BE IT ENACTED by the Legislative Assembly of the Cook Islands in session assembled, and by the authority of the same, as follows:

  1. Short Title and commencement

(1) This Act may be cited as the Civil List Amendment Act 1980 and shall be read together with and deemed part of the Civil List Act 1968 (hereinafter referred to as the "principal Act").

(2) The provisions of this Act, with the exception of Sections 11, 12 and 13 shall be deemed to have come into force on the 1st day of August 1980.

(3) Sections 11, 12 and 13 shall come into force on the date of Assent.

  1. Interpretation

Section 3 of the principal Act is hereby amended by inserting between the words "Outer Islands" and their definition and the word "overseas" and its definition the following:

"Official State Function: means a function for which an official invitation has been tendered by the Government or Head of State of the host country."
  1. Salary of the Premier

Section 4 of the principal Act (as amended by the Civil List Amendment Act 1978-79 No.14) is hereby amended by omitting from paragraph (a) the word "ten" and substituting the word "fifteen".

  1. Salary and Allowances of Deputy Premier

Part IIB of the principal Act is hereby amended by:

(1) Deleting the words "Deputies to the Premier" and "a Deputy to the Premier" and substituting therefore the words "Deputy Premier".
(2) Omitting from Section 20.I the word "each".
(3) Omitting from Section 20.1:

(4) Repealing Section 20J substituting therefore:

"20J - Functions of Deputy Premier
The Deputy Premier shall perform such functions as shall be prescribed for him by the Premier".
  1. Salaries of Ministers

Section 5 of the principal Act (as amended by Section 3 of the Civil List Amendment Act 1978-79 No.14) is hereby amended by omitting from paragraph (a) the word "eight" and substituting therefore the word "twelve".

  1. Salary and Allowances of the Leader of the Opposition

Section 12 of the principal Act is hereby repealed and the following section substituted therefore:

"12. Salary and Allowances of Leader of Opposition
There shall be paid to the member of the Legislative Assembly who is for the time being leader of the official opposition: -
  1. Salary of Speaker

Sub section (1) of section 10 of the principal Act (as amended by section 5 of the Civil List Amendment Act 1977, No. 8) is hereby amended by:-

(a) omitting from paragraph (a) the word "nine" and substituting the words "ten thousand."
(b) an allowance at the rate of one thousand dollars a year to provide for expenses incurred in connection with his official duties and his duties in connection with the Legislative Assembly
  1. New section inserted

The principal Act is hereby further amended by inserting after section 11 the following new section:-

"11A. Allowance of the Deputy Speaker
There shall be paid to the Deputy Speaker an allowance at the rate of five hundred dollars a year to provide for expenses incurred in connection with his official duties and his duties in connection with the Legislative Assembly."
  1. Salary and Allowances of Assistants to the Ministers

Part IIA of the principal Act (as inserted by the Civil List Amendment Act 1969 No. 17) is hereby amended by repealing Section 20D and substituting therefore the following:-

"20D. Remuneration of Assistants to the Ministers -
There shall be paid to each Assistant to the Ministers -
  1. Salaries of Members

Section 13 of the principal Act (as amended by Section 6 of the Civil List Amendment Act 1977 (No. 8) is hereby amended by omitting the words "four thousand" and substituting therefore the words "six thousand five hundred".

  1. Boarding Allowance

Section 16 of the principal Act is hereby amended by omitting the words "four dollars and fifty cents" and substituting the words "seven dollars".

  1. Travelling Allowances and expenses of members visiting Constituencies

Section 17 of the principal Act is hereby amended by omitting from sub-section (2) the words "five dollars" and substituting the words "ten dollars".

  1. Travelling Allowances and Expenses of Members travelling within the Cook Islands on public service

Section 18 of the principal Act is hereby amended by repealing the proviso thereto and substituting the following:-

"Provided that the rate of the travelling allowance payable under this Section will not exceed the actual hotel, motel or other accommodation house tariff, or the sum of ten dollars per day where the member is accomodating privately".
