An Act of the Legislative Assembly of the Cook Islands to appropriate certain sums of money out of the Cook Islands Government Account to the services of the year ending with the thirty-first day of March, 1966, and to appropriate the supplies granted in this year.

MOST GRACIOUS SOVEREIGN, - We, your Majesty's most dutiful and loyal subjects, the Legislative Assembly of the Cook Islands, towards making good the supply which we have cheerfully granted to Your Majesty in this year, have resolved to grant unto Your Majesty the sums hereinafter mentioned and do therefore most humbly beseech Your Majesty that it may be enacted: And be it enacted by the Legislative Assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:

1. Short Title

This Act may be cited the Cook Islands Appropriation Act 1965, and relates to the year ending on the thirty-first day of March 1966 (hereinafter referred to as "this year").

2. Grant and appropriation of £1,722,400 out of the Cook Islands Government Account -

(1) The Minister of Finance may issue and apply out of the Cook Islands Government Account, towards making good the supplies granted to Her Majesty for the services of this year, any sums which do not exceed the sum of £1,722,400.

(2) The sums hereinbefore authorised to be applied, together with the fees collected by such public officers as are authorised to retain them instead of salary, are hereby appropriated for the services expressed in the several votes specified in the First Schedule to this Ordinance.

3. Indemnity as to Unauthorised Expenditure of £77,585

Whereas the Resident Commissioner has, under the authority of Section 19 of the Public Revenues Ordinance, 1958, issued during the year that ended with the thirty-first day of March, 1965, in excess of or without the appropriation of the Cook Islands Legislative Assembly, the respective sums mentioned in the Fourth Schedule to this Act, out of the Cook Islands Assembly Account and the other accounts mentioned in the schedule, amounting in the whole to the sum of £77,585, and has caused those sums to be applied to the several services mentioned in the said Second Schedule:

Be it therefore enacted that the application of the said sums is hereby sanctioned.

4. Authority to write off Losses of Public Money and Public Stores amounting to £4,405.3.3.

Whereas the losses of Public money and public stores specified in the Third Schedule to this Act have occurred, amounting in the whole to four thousand four hundred and five pounds three shillings and three pence: Be it therefore enacted as follows:

(1) The amounts specified in the said Third Schedule, being sums of public money and the value of public stores and the amounts of claims abandoned, are hereby written off.

(2) No person, other than an accounting officer within the meaning of the Public Revenues Ordinance, 1958, shall be deemed to be discharged by reason only of the fact that the said amounts are written off, from any liability in respect of any public money or public stores (other than claims abandoned to which this section applies).

5. Indemnity as to Expenditure not Previously Appropriated

Whereas the Resident Commissioner has, under the authority of the Public Revenues Ordinance, 1958, incurred, without the appropriation of the Cook Islands Legislative Assembly, the respective sums mentioned in the Fourth Schedule to this Ordinance, out of the Cook Islands Assembly Account, amounting in the whole to four hundred and sixty-one pounds two shillings and three pence and has caused those sums to be applied to the several services mentioned in the Fourth Schedule: Be it therefore enacted that the application of the said sums is hereby sanctioned.

6. Salaries of Judges

There shall be paid to the Judges of the High Court and the Land Court out of the Cook Islands Government Account without further appropriation than this Act salaries at the following rates:-

(a) To the Chief Judge of the High Court at the rate of two thousand five hundred and thirty pounds a year, together with such further sum or sums as allowances as the Executive Council may from time to time decree.
(b) To the Chief Judge of the Land Court at the rate of two thousand five hundred and thirty pounds a year together with such further sum or sums as allowances as the Executive Council may from time to time decree.

7. Salary of the Secretary of the Premier's Department

There shall be paid to the Secretary of the Premier's Department out of the Cook Islands Government Account without further appropriation than this Act as from the fourth day of August one thousand nine hundred and sixty-five a salary at the rate of two thousand four hundred and five pounds a year together with such further sum or sums as allowances as the Executive Council may from time to time decree.
