COOK ISLANDS AMENDMENT ACT 1965

An Act to amend the Cook Islands Act 1915
[7 June 1965
1.
Short Title - This Act may be cited as
the Cook Islands Amendment Act 1965, and shall be read together with and deemed
part of the Cook Islands Act 1915 (hereinafter referred to as the principal
Act).
2.
Repealed on 4 August 1965 (the date of the commencement of the Cook Islands
Amendment Act 1964) by s. 2(3) of the Cook Islands Amendment Act 1965; see S.R.
1965/128/2.
3.
Amendments consequential on amendments to the Constitution
- (1) The principal Act is hereby amended
in the manner indicated in the First Schedule to this
Act.
(2) The enactments specified
in the Second Schedule to this Act are hereby amended in the manner indicated in
that Schedule.
(3) Subsections (1)
and (2) of section 57 of the Cook Islands Amendment Act 1964 and the Second and
Third Schedules to that Act are
hereby
repealed.
(4)
This subsection
amended s. 57(3) of the Cook Islands Amendment Act
1957.
(5)
Subsections (1), (2), and (4) of this
section shall come into force on the date of the commencement of the Cook
Islands Constitution
Act 1964.
The Cook Islands Constitution Act 1964 came into force on 4 August 1965; see S.R. 1965/128/2.

Act, where they appear in this reprint.
Parts of this Schedule have been repealed by the following enactments:
Cook Islands Amendment Act 1966, s. 2(1) and (3).
Cook Islands Amendment Act 1967, s. 6(c).
Cook Islands Amendment Act 1970, s. 2(2)(g).

The amendments specified in this item have been incorporated in the reprint of the Government Superannuation Fund Act 1956. By inserting in section 28(3), after the words ["Minister of Foreign Affairs"], the words "in the case of any person resident in Niue or in the Tokelau Islands, and with the Minister of the Government of the Cook Islands who is responsible for civil aviation in the case of any person resident in the Cook Islands other than Niue". By adding to section 28 the following subsection: "(4)
For the purposes of the application of this Act to the Cook Islands other than
Niue, every reference in this Act to any Minister
shall be construed as a
reference to the Minister of the Government of the Cook Islands who is
responsible for civil aviation."

The
amendments to Cook Islands amending Acts have been incorporated in the
enactments affected, where they appear in this reprint.
The reference to the Government Superannuation Fund Act 1956, being the corresponding enactment in force at the date of this reprint, has been substituted for the former Superannuation Act 1956.
The reference to the Minister of Foreign Affairs was substituted for a reference to the Minister of Island Territories by s. 2(4)(a) of the Niue Amendment Act 1974 and s. 2(3)(a) of the Tokelau Amendment Act 1974.
Parts of this Schedule have been repealed by the following enactments:
Customs Act 1966, s. 311(1) (impliedly).
Cook Islands Amendment Act 1966, ss. 2(2) and (3), and 3(2)(d).
Cook Islands Amendment Act 1970, s. 2(2)(g).
