An Act to prohibit leases of land on Aitutaki Motus

(28 August 1970)

BE IT ENACTED by the Legislative Assembly of the Cook Islands in Session assembled, in accordance with the provisions subclause (1) of Article 41 of the Constitution of the Cook Islands, and by the authority of the same, as follows:

1. Short Title - This Act may be cited as the Aitutaki Motus Prohibition of Leases Act 1970.

2. Prohibition of Leases - (1) Notwithstanding anything contained in the Cook Islands Act 1915 or any other enactment or any order of any Court, no person shall be capable of leasing any land on any of the Motus Aitutaki set out in the Schedule to this Act.

(2) Nothing is this section shall affect any interest acquired in any land prior to the commencement of this Act.

3. Article 40 excluded - Article 40 the Constitution shall have no application with regard to the provisions of this Act.
